I agree to accept all responsibility and liability for any loss or damage to the hired product, however caused, which occurs during the course of the hire period. I agree to compensate the operator for any loss including damage to the board leg role and fins. Please report any damage to the surfboard to the operator list on the side of the kiosk.

I understand that I may be filmed during the hire process.

I (in this document means either me the hirer or if under 18 years of age, my parents /guardians) ACKOWLEDGE, agree and understand the nature of Surfboard Riding Activities and I am qualified, in good health, and in proper physical condition to ride a surfboard. Surfing involves risks and dangers of serious bodily injury, including permanent disability, paralysis, and death (“risks”).

I further acknowledge that surfing will be conducted in an ocean which may or may not be patrolled and which at all times be dangerous to surfers where the hazards of surfing are to be expected.

I ACKNOWLEDGE and understand that neither the operator nor the owner will be giving me instructions on how to surf or how to remain safe in the ocean nor will they be overseeing the activity. I acknowledge that I am a competent ocean swimmer and can ride a surfboard.

I AGREE that the Operator and/owner of the Surfboard HIRE Business including its officers employees or agents shall not be liable to any person (be they the hirer or any other person) intort, contract, under statute or otherwise for any injury, loss, damage, death, economic loss whatsoever suffered by me ,whether consequential, direct or indirect, caused by or connected with my participation in the activity.

I am 18 years of age or older ( or am a parent or guardian of the surfboard user) and have read and understood the terms of this release agreement and I understand that I am giving up substantial rights by agreeing to this agreement and that I have agreed to it voluntarily and without any inducement or assurance of any nature and intend it to be a complete and unconditional release of all liability to the greatest extent allowed by law. I agree if any portion of this agreement is held to be invalid, the balance, notwithstanding, shall continue in full force and effect.

I HEREBY RELEASE,DISCHARGE,COVENANT NOT TO SUE the operator/owners or their respective administrators , directors, agents , officers, members, employees, sponsors, advertisers, from all liability claims , demands losses or damages on my account caused or alleged to be caused in whole or in art by the negligence of the operator or otherwise , including negligent rescue operations and I further agree, that if despite this release and waiver of liability, assumption of risk and indemnity agreement, I or anyone on my behalf , makes a claim against the releases, 

I will indemnify, save and hold harmless each of the operator from any litigation expenses, attorney fees, loss, liability , damage , or cost which may occur as the result of such claim.
